Itemالجزاءات الا دارية كآلية لحماية البيئة في الجزائر(جامعة الشاذلي بن جديد الطارف, 2026-06-14) لعبيدي وردة ; العارك جليلةعملت الجزائر على إرساء منظومة قانونية لحماية البيئة، تتجسد في القانون رقم 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة، إلى جانب مجموعة من القوانين الخاصة المنظمة لمجالات بيئية مختلفة، كما دعمت الجزائر هذه المنظومة بآليات ردعية، من بينها الجزاءات الإدارية البيئة المالية وغير المالية التي تمكن الإدارة من التدخل السريع لمواجهة المخالفات البيئية، والحد من أثارها دون اللجوء إلى القضاء، غير أن فعالية هذه الجزاءات تصطدم عمليا بعراقيل إجرائية وإدارية حالت دون تحقيق هذه الجزاءات فعاليتها في حماية البيئة. Algeria has worked to establish a legal system for the protection of the environment, embodied in Law No. 03-10 relating to the protection of the environment within the framework of sustainable development, in addition to a set of special laws regulating different environmental fields. Algeria has also supported this system with deterrent mechanisms, including administrative environmental penalties, financial and non-financial, which enable the administration to intervene quickly to confront environmental violations and reduce their effects without resorting to the judiciary. However, the effectiveness of these penalties is practically hindered by procedural and administrative obstacles that have prevented these penalties from achieving their effectiveness in protecting the environment.
