Itemالحق في اللجوء السياسي في القانون الدولي لحقوق الانسان(جامعة الشاذلي بن جديد الطارف, 2021) العرباوي زهرة ; بودوح خولةرغم الجهود المبذولة لإقرار الحق في اللجوء السياسي الناتج عن الاضطهاد السياسي كحق من حقوق الانسان على نحو يكفل لملتمس اللجوء الحماية والملجأ الآمن، غير أن هذه الجهود اصطدمت بالمبدأ التقليدي المستقر المتمثل في حق دولة الملجأ في منح اللجوء داخل اقليمهاأو رفضه، باعتبار اللجوء حقا يخضع للسلطة التقديرية لدولة الملجأ، وأن القانون الدولي لحقوق الانسان لا يعترف للاجئ السياسي بالحق في اللجوء، بل بالحق في طلب اللجوء أو التماسه. غير أن قبول دولة الملجأ منح الحماية لملتمس اللجوء السياسي يجعلها من جهة أخرى خاضعة لالتزامات اتجاه اللاجئ السياسي أهمها حظر تسليمه، ناهيك عن التزامها بكفالة الحقوق المعترف بها للاجئ السياسي كغيره من الأشخاص في إطار القانون الدولي لحقوق الانسان. All efforts that have been made to establish the right to political asylum that result from political persecution and make it a human right in a way that provides the person who requests this right protection, refuge and safety. These efforts have contradicted the established traditional principle of the right of the state of asylum to grant asylum within its territory or to refuse it, since this asylum is considered a right subject to the discretion of the state of asylum, and international human rights law does not recognize the right to asylum but rather the right to seek asylum. or solicit it. The acceptance of the state of asylum to grant protection to the asylum-seeker, on the other hand, makes it subject to obligations towards the political refugee, the most important of which is the prohibition of his extradition, as well as its obligation to provide the recognized rights of the political refugee like other persons within the framework of international human rights law.
