    حجية المحررات الالكترونية في الإثبات في التشريع الجزائري

    يدرس هذا البحث العلمي القانوني موضوع المحررات الالكترونية وحجيتها في الاثبات، التي أصبحت الوسيلة الرائجة للتعاقد في السنوات الأخيرة نتيجة الثورة الرقمية الحديثة. فتطرقنا لمفهوم المحررات الالكترونية التي تختلف في تسميتها من تشريع لآخر والتي تضمن عنصرين الكتابة الالكترونية والتوقيع الالكتروني. منح المشرع الجزائري للكتابة الالكترونية نفس حجية الكتابة التقليدية بعد استقاءها لشروط ذكرت على سبيل الحصر، نفس الحال بالنسبة للتوقيع الالكتروني الذي ضبط بشروط لمختلف صوره، حتى تضفى عليه نفس حجية التوقيع العادي ويعتد به كوسيلة للإثبات. This scientific legal research studies the issue of electronic documents and their validity in proof, which have become the popular means of contracting in recent years as a result of the modern digital revolution. We discussed the concept of electronic documents, which differ in name from one legislation to another, and which include two elements: electronic writing and electronic signature. The Algerian legislator granted electronic writing the same authority as traditional writing after it met the conditions mentioned exclusively. The same applies to the electronic signature, which was set under conditions for its various forms, so that it is given the same authority as a regular signature and is considered as a means of proof.
