Abstract

في سياساته الجزائية، منح التشريع الجزائري القاضي الجنائي صلاحيات واسعة في تقدير العقوبة ومنحها وفقًا لبيانات الملف المعروض عليه، متماشيًا مع السياسة الجزائية التي أرساها التشريع الحديث، ومنشئًا آلياتٍ تُمثل معادلةً موازيةً لتحقيق أقصى درجات العدالة الجنائية، بحيث يمارس القاضي الجنائي سلطته الواسعة في العقاب والعقاب بعيدًا عن كل تجاوزٍ غير مشروع.
