Abstract

أورد المشرع الجزائري حماية قانونية شاملة للعلامة التجارية، تشمل الحماية الجزائية والمدنية. مع ذلك، تُقتصر الحماية الجزائية على العلامة التجارية المسجلة فقط، بينما يمكن حماية العلامة غير المسجلة عبر دعوى المنافسة غير المشروعةتشمل الحماية الجزائية المقررة للعلامة التجارية مختلف صور التعدي عليها، مثل: جريمة تقليد العلامة التجارية، جريمة عدم وضع العلامة على السلعة أو الخدمة وجريمة ممارسة تجارية غير نزيهة. يترتب على ارتكاب هذه الجرائم عقوبات صارمة، تتضمن، الغلق النهائي أو المؤقت للمؤسسة المخالفة، مصادرة الأدوات والوسائل المستخدمة في ارتكاب المخالفة وإتلاف الأشياء المستعملة في التعدي على العلامة التجارية، وبهذه الأحكام، يعزز المشرع الجزائري من حماية العلامات التجارية ويضمن تنفيذ العقوبات الرادعة على كافة صور التعدي عليها. الكلمات المفتاحية: علامة تجارية، الحماية المدنية، الحماية الجزائية، جريمة التقليد. The Algerian legislature has established comprehensive legal protection for trademarks, encompassing both criminal and civil protection. However, criminal protection is limited to registered trademarks only, while unregistered marks can be protected through unfair competition lawsuits.
