الآليات القانونية لحماية براءة الإختراع في الجزائر

Abstract

براءة الاختراع وثيقة يمنحها المشرع للمخترع بهدف ضمان حقوقه، إذا توافرت فيها شروط منها الموضوعية كضرورة وجود اختراع و القابلية للتطبيق الصناعي ...الخ ، وأخرى شكلية مثل الطلب والفحص....الخ، كما حدد المشرع مدة سريانها بعشرون سنة غير قابلة للتجديد حيث تنقضي بعد مضي هاته المدة. ونظرا للأهم ي ة البالغة لبراءة الاختراع كونها السبب الرئيسي في التطور والرفاهية التي يشهدها العالم اليوم حضيت بحماية دولية كما اهتمت التشريعات الداخلية على غرار المشرع الجزائري حيث منحها حماية خاصة من خلال آليات وقائية وردعية كدعوى المنافسة غير المشروعة ودعوى التقليد وأحاطها بأشد العقوبات في حال تم الاعتداء عليها. The patent is a document granted by the legislator to the inventor in order to guarantee his rights if objective condition are met it such as the necessity for the existance of the invention, industrial applicability and other formalities such as application and examination. -107- The legislator also specified its validity period for twenty years non-renewable the developpement and well being that the word witnessing today urges international potection legislator has also taken care of it by giving it special protection through preventive mechanisons, such as unfair competition lawsuits and conterfeiting lawsuits, with severe penalities if it is attackted.
