جريمة المضاربة غير المشروعة في التشريع الجزائري

Abstract

حاول المشرع الجزائري حماية المستهلك من الممارسات غير المشروعة التي يتعرض لها، من بينها المضاربة غير المشروعة، التي عرفت انتشارا واسعا في الجزائر، خاصة بعد انتشار وباء كورونا الذي أثر كثيرا على القدرة الشرائية للمواطن، وعليه قام المشرع الجزائري باستحداث قانون خاص لتجريم المضاربة غير المشروعة يتمثل في القانون رقم21-15 بعدما كان ينظمها سابقا بموجب قانون العقوبات، أين حدد هذا القانون صور المضاربة غير الدشروعة وأركانها. ونظرا لأن مثل هذه الجرائم الاقتصادية تمس بمصالح المستهلك والوطن فإن المشرع الجزائري جعل مهمة مكافحة هذه الجريمة مشتركة بين الدولة والجماعات المحلية وجمعيات حماية المستهلك وكذا المجتمع المدني وقطاع االإعلام، ورصد المشرع الجزائري عقوبات ردعية صارمة لمكافحة هذا النوع من الجرائم

The Algerian legislator tried to protect the consumer from the illegal practices he is exposed to, including illegal speculation, which was widespread in Algeria, especially after the spread of the Corona epidemic, which greatly affected the purchasing power of the citizen, and accordingly the Algerian legislator introduced a special law to criminalize illegal speculation. It is represented in Law No. 15-21 after it was previously regulated under the Penal Code, where this law defines the forms and elements of illegal speculation. Given that such economic crimes affect the interests of the consumer and the nation, the Algerian legislator has made the task of combating this crime joint between the state, local groups, consumer protection associations, as well as civil society and the media sector, and the Algerian legislator has monitored strict deterrent penalties to combat this type of crime.
