Abstract
تبنى المشرع الجزائري بدائل جديدة للدعوى العمومية وأقرها بموجب القانون رقم 14-25 المتضمن قانون الإجراءات الجزائية؛ وتتمثل هذه البدائل في الوساطة الجزائية، والأمر الجزائي، وإجراءات المثول الفوري. وعلاوة على ذلك، استُحدث نظام جديد يتمثل في إجراء المثول بناءً على اعتراف مسبق بالذنب. تهدف هذه الدراسة إلى تحليل الأطر القانونية التي تشكل الأساس القانوني لهذه البدائل، فضلاً عن بيان مدى فعالية هذه الآليات المستحدثة في الحد من عدد القضايا الجزائية المعروضة على المحاكم. وقد خلصت الدراسة إلى أن هذه الأنظمة ترتكز في جوهرها على مبادئ التفاوض والمصالحة والرضائية؛ إذ تمنح وزناً أكبر لإرادة الأطراف المعنية، وتُمكن النيابة العامة من حسم الدعاوى العمومية دون اللجوء إلى إجراءات التقاضي العادية، مما يمثل نموذجاً جديداً للتحول في السياسة الجزائية من العدالة العقابية إلى العدالة القائمة على التفاوض والرضائية.
The Algerian legislator adopted and adhered to newly introduced alternatives to public prosecution under Law 25-14, which includes the Code of Criminal Procedure. These alternatives consist of criminal mediation, the penal order, and the immediate appearance procedure. Furthermore, a new system was introduced: the procedure of appearance based on a prior confession of guilt. This study aims to analyze the legal frameworks that form the legal basis for these alternatives, as well as to reveal the extent of the effectiveness of these newly introduced mechanisms in reducing the number of criminal cases brought before the courts. We concluded that these systems are fundamentally based on the principles of negotiation, reconciliation, and consensualism. They give greater weight to the will of the parties involved and empower the Public Prosecutor's Office to conclude public prosecutions without resorting to ordinary litigation procedures. They represent a new model for the shift in criminal policy from punitive justice to negotiated and consensual justice.
