Abstract
تتناول هذه الدراسة فعالية الإطار القانوني والمؤسسي الذي يحكم التنظيم المصرفي في الجزائر، مع التركيز على الإصلاحات الهيكلية العميقة التي أدخلها قانون النقد والمصارف الجديد رقم 23-09 لمواكبة التحولات الاقتصادية والتكنولوجية العالمية.
وباستخدام المنهجين الوصفي والتحليلي والتاريخي،
تحلل الدراسة الصلاحيات التنظيمية والإشرافية الممنوحة لمجلس النقد والمصارف وهيئة المصارف،
مع التركيز على التحول نحو الإشراف الاحترازي والاستباقي القائم على المخاطر.
وتخلص الدراسة إلى أنه على الرغم من أن التشريع الجديد
يحقق إنجازًا هامًا من خلال دمج لوائح الدفع الرقمي، والاعتراف بالبنوك الرقمية، وتقنين التمويل الإسلامي، إلا أن الممارسة الميدانية لا تزال تواجه تحديات وعقبات استراتيجية. ومن أبرز هذه العقبات: نقص المهارات الرقمية في مجال الأمن السيبراني، والمخاطر الأخلاقية الناتجة عن الهيمنة الهيكلية للبنوك العامة، والسرية الصارمة لإجراءات التفتيش. تُختتم الدراسة بضرورة تعزيز الضمانات القانونية لاستقلالية الهيئات الرقابية، مع تسريع إنشاء نظام إبلاغ رقمي موحد وفوري بين البنوك التجارية والبنك المركزي، وذلك لضمان الاستقرار المالي وحماية المودعين.
Résumé :
Cette étude examine l'efficacité du cadre juridique et institutionnel régissant la réglementation bancaire en Algérie, en se concentrant sur les profondes réformes structurelles introduites par la nouvelle loi monétaire et bancaire n° 23-09 afin de s'adapter aux transformations économiques et technologiques mondiales. Utilisant des méthodes descriptives-analytiques et historiques, la recherche analyse les pouvoirs de réglementation et de supervision conférés au Conseil monétaire et bancaire et à la Commission bancaire, en mettant l'accent sur l'évolution vers une supervision prudentielle et proactive axée sur le risque. L'étude constate que si la nouvelle législation représente une avancée significative grâce à l'intégration de la réglementation des paiements numériques, la reconnaissance des banques numériques et la codification
de la finance islamique, la pratique sur le terrain reste confrontée à des défis importants et à des obstacles stratégiques. Parmi les principaux figurent le déficit de compétences numériques en cybersécurité, l'aléa moral résultant de la domination structurelle des banques publiques et la stricte confidentialité des procédures d'inspection. L’étude conclut sur la nécessité de renforcer les garanties juridiques d’indépendance des organismes de réglementation, tout en accélérant la mise en place d’un système de reporting numérique unifié et en temps réel entre les banques commerciales et la Banque centrale afin d’assurer la stabilité financière et de protéger les déposants.
Abstract:
This study examines the effectiveness of the legal and institutional framework
governing banking regulation in Algeria, focusing on the deep structural reforms introduced
by the new Monetary and Banking Law No. 23-09 to keep pace with global economic and
technological transformations. Utilizing both descriptive-analytical and historical methods,
The research analyzes the regulatory and supervisory powers vested in the Monetary and
Banking Council and the Banking Commission, with an emphasis on the shift toward risk
Based on prudential and proactive supervision. The study finds that while the new legislation
achieves a significant milestone by integrating digital payment regulations, recognized
digital banks, and codifying Islamic finance, field practice still faces critical challenges and
strategic hurdles. Chief among these are the digital skills gap in cybersecurity, moral hazard
resulting from the structural dominance of public banks, and the strict confidentiality of
inspection procedures. The study concludes with the necessity of strengthening the legal
guarantees for the independence of regulatory bodies while accelerating the establishment of a
unified, real-time digital reporting system between commercial banks and the Central Bank to
Ensure financial stability and protect depositors.
