Abstract

يعتبر الإفراج المشروط من أهم الأنظمة العقابية الحديثة التيس تهدف إلى إصلاح المحموم عليه وإعادة إدماجه في المجتمع والحد من عودته إلى الجريمة. وقد تبنى المشرع الجزائري هذا النظام كوسيلة لتحقيق التأهيل الاجتماعي للمحبوسين، مع توسيع الجهات المختصة بمنحه لتشمل قاضي تطبيق العقوبات ووزير العدل، بما يعكس توجه الساسة العقابية نحو تعزيز فعالية إعادة الإدماج الاجتماعي للمحكوم عليهم.

Parole is considered one of the most important modern penal systems, aiming to rehabilitate offenders, reintegrate them into society, and reduce recidivism. The Algerian legislature has adopted this system as a means of achieving the social rehabilitation of prisoners. With the expansion of the authorities responsible for granting it to include the judge of the application of penalties and the Minister of Justice, this reflects the direction of penal policy towards enhancing the effectiveness of the social reintegration of convicts.

La libération conditionnelle est considérée comme l'un des systèmes pénitentiaires modernes les plus importants, visant à réhabiliter les délinquants, à les réintégrer dans la société et à réduire la récidive. Le législatif algérien a adopté ce système comme moyen d'assurer la réhabilitation sociale des prisonniers. Avec l'élargissement des pouvoirs chargés de l'octroiement, incluant le juge chargé de l'application des peines et le ministre de la Justice, cela reflète l'orientation de la politique pénale visant à renforcer l'efficacité de la réinsertion sociale des condamnés.
