Abstract
تتناول هذه الدراسة موضوع الرقابة الدستورية على التشريعات المتعلقة بالحريات العامة في الجزائر، في ظل التعديل الدستوري لسنة 2020 وما أرساه من إصلاحات جوهرية في بنية الرقابة الدستورية، وتنطلق الدراسة من إشكالية مركزية تتمحور حول نطاق الرقابة الدستورية على التشريعات المتعلقة بالحريات العامة، ومدى فاعلية هذه الرقابة في ضمان حماية للحريات العامة كما هي مكرسة في الدستور وتُظهر الدراسة أن ما جاء به المؤسس الدستوري من إصلاحات على آلية الرقابة الدستورية من ناحية توسيع نطاقها برقابة سابقة ولاحقة ورقابة جوازيةووجوبية، ومن ناحية أخرى باستحداث المحكمة الدستورية كهيئة يغلب عليها الطابع القضائي كبديل للمجلس الدستوري كهيئة سياسية، قد ساهم في ضمان فعالية للحريات العامة، غير أن هذه الفعالية ليست مطلقة بل تعتريها قيود إجرائية وموضوعية تنتقص من فعالية الآداء الرقابي للمحكمة الدستورية، وتنتهي الدراسة إلى جملة من التوصيات تستهدف تيسير شروط الدفع بعدم الدستورية، وتعزيز استقلالية المحكمة الدستورية. This study examines the issue of constitutional review of legislation related to public freedoms in Algeria, in light of the 2020 constitutional amendment and the fundamental reforms it introduced to the structure of constitutional review. The study begins with a central question concerning the scope of constitutional review of legislation related to public freedoms and the extent to which this review is effective in guaranteeing the protection of public freedoms as enshrined in the Constitution. The study demonstrates that the constitutional reforms introduced by the framers to the mechanism of constitutional review—both in terms of expanding its scope to include prior and subsequent review, as well as discretionary and mandatory review, and in terms of establishing the Constitutional Court as a predominantly judicial body replacing the Constitutional Council as a political body—have contributed to ensuring the effectiveness of public freedoms. However, this effectiveness is not absolute; it is subject to procedural and substantive limitations that diminish the effectiveness of the Constitutional Court's oversight role. The study concludes with a set of recommendations aimed at simplifying the conditions for challenging the constitutionality of legislation and strengthening the independence of the Constitutional Court. Cette étude examine la question du contrôle de constitutionnalité des lois relatives aux libertés publiques en Algérie, à la lumière de la révision constitutionnelle de 2020 et des réformes fondamentales qu'elle a introduites dans la structure de ce contrôle. L'étude s'ouvre sur une question centrale concernant la portée du contrôle de constitutionnalité des lois relatives aux libertés publiques et son efficacité à garantir la protection des libertés publiques telles qu'elles sont consacrées par la Constitution. L'étude démontre que les réformes constitutionnelles introduites par les rédacteurs de la Constitution au mécanisme de contrôle de constitutionnalité – tant en termes d'élargissement de son champ d'application pour inclure le contrôle préalable et postérieur, ainsi que le contrôle discrétionnaire et obligatoire, qu'en termes d'établissement de la Cour constitutionnelle comme organe essentiellement judiciaire en remplacement du Conseil constitutionnel, organe politique – ont contribué à garantir l'efficacité des libertés publiques. Cependant, cette efficacité n'est pas absolue ; elle est soumise à des limitations procédurales et substantielles qui en diminuent l'efficacité du rôle de contrôle de la Cour constitutionnelle. L'étude conclut par une série de recommandations visant à simplifier les conditions de contestation de la constitutionnalité des lois et à renforcer l'indépendance de la Cour constitutionnelle.
