Abstract
أدى التطور المتسارع لتكنولوجيا الإعلام والاتصال إلى ظهور فضاء رقمي جديد يُعرف بالفضاء لسيبراني، والذي أحدث تغيرات كبيرة في حياة الأفراد والمؤسسات. ورغم ما وفره هذا الفضاء من مزايا عديدة، فقد صاحبه انتشار أنماط جديدة من الجرائم عُرفت بالجرائم الإلكترونية أوالمعلوماتية، والتي تتطور باستمرار مع تطور التقنيات الحديثة.
وتشمل هذه الجرائم العديد من الأفعال غير المشروعة، مثل الاختراق وسرقة البيانات والابتزاز الإلكتروني والاحتيال عبر الشبكات، كما قد تمتد آثارها إلى المؤسسات والدول من خلالاستهداف الأنظمة والشبكات الحيوية وتعطيل الخدمات الأساسية. ويستغل مرتكبو هذه الجرائم التقنيات الرقمية لتنفيذ أفعالهم الإجرامية بسهولة وسرعة، مما يسبب أضراراً مادية ومعنوية جسيمة.
وانطلاقاً من خطورة هذه الظاهرة، يهدف هذا البحث إلى بيان مفهوم الجريمة الإلكترونية وخصائصها، وبيان أهم الآليات القانونية التي اعتمدها المشرع الجزائري لمكافحتها، مع دراسة المسؤولية الجنائية المترتبة عنها، سواء تعلق الأمر بالشخص الطبيعي أو الشخص المعنوي، وذلك في إطار تعزيز الحماية القانونية للأفراد والمؤسسات في البيئة الرقمية.
The rapid development of information and communication technologies has led to the emergence of a new digital environment known as cyberspace. While this environment has provided numerous benefits for individuals and institutions, it has also facilitated the spread of new forms of crime, commonly referred to as cybercrime or computer-related crime, which continue to evolve alongside technological advancements.
Cybercrime encompasses a wide range of illegal activities, including hacking, data theft, electronic blackmail, and online fraud. The impact of these crimes extends beyond individuals to affect institutions and even states, particularly through attacks targeting critical networks and infrastructure or disrupting essential services. Cybercriminals exploit modern technologies and information networks to carry out their unlawful activities with greater speed and efficiency, causing significant material and moral harm.
Given the seriousness of this phenomenon, this research aims to examine the concept and characteristics of cybercrime, as well as the legal mechanisms adopted by the Algerian legislator to combat it. The study also addresses the criminal liability arising from such offenses, whether committed by natural persons or legal entities, with the objective of strengthening legal protection for individuals and institutions within the digital environment.
