جرائم الصفقات العمومية في ظل القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته المعدل والمتمم

Abstract

تتناول هذه الدراسة "جرائم الصفقات العمومية في التشريع الجزائري" كآلية قانونية لحماية المال العام من الهدر والاستنزاف. تسلط الدراسة الضوء على الإطار الموضوعي للجرائم المرتبطة بهذا القطاع، بدءاً من مراحل الإعداد والتحضير وصولاً إلى التنفيذ، مع تحليل دقيق للسياسة الجنائية التي شملت المسؤولية الجزائية للأشخاص الطبيعيين والمعنويين على حد سواء. كما تستعرض الدراسة المنظومة العقابية الصارمة والآليات الإجرائية المعتمدة لمكافحة الفساد، مع تقييم فعالية النصوص القانونية في ظل التحديات الاقتصادية الراهنة. وتخلص الدراسة إلى أن نجاعة الترسانة القانونية الجزائرية مرتبطة ارتباطاً وثيقاً بتطوير الأدوات الرقابية التقنية وتعزيز التخصص القضائي لمواجهة أساليب الإجرام الاقتصادي الحديثة.

This study addresses "Public Procurement Crimes in Algerian Legislation" as a legal mechanism to protect public funds from waste and depletion. The study highlights the substantive framework of crimes associated with this sector, from the preparation and tendering stages to execution, while providing a rigorous analysis of the criminal policy that encompasses both natural and legal persons. Furthermore, the study examines the strict penal system and procedural mechanisms adopted to combat corruption, evaluating the effectiveness of legal provisions in light of current economic challenges. The study concludes that the efficacy of the Algerian legal arsenal is closely linked to the development of technical oversight tools and the enhancement of judicial specialization to counter modern forms of economic crime. .
