Abstract
تناول هذا البحث بالدراسة والتحليل نظام رد الاعتبار الجزائي في التشريع الجزائري باعتباره أحد
الركائز الأساسية التي تقوم عليها السياسة العقابية المعاصرة، الهادفة إلى تحقيق التوازن بين حق المجتمع
في الردع وحق المحكوم عليه في الاندماج مجدداً كعنصر فاعل ومستقيم. تتبعت الدراسة الإطار
المفاهيمي لرد الاعتبار من خلال تبيان ماهيته وجذوره التاريخية والفلسفية القائمة على "الحق في
النسيان الجنائي" ومحو وصمة الجريمة وآثارها السلبية، مع تمييزه الدقيق عن الأنظمة القانونية المشابهة
كالعفو وتقادم العقوبة، كما تم تشريح المسار الإجرائي والضوابط والشروط الدقيقة التي رسمها قانون
06- 04 والقانون 18 - الإجراءات الجزائية الجزائري )بما في ذلك التعديلات المتلاحقة والأمر 05
14 (، مستعرضاً آليات رد الاعتبار القانوني - وصولاً إلى أحكام التعديل الجديد في القانون رقم 25
والقضائي، والآثار المترتبة عليهما في استعادة الحقوق وتطهير صحيفة السوابق القضائية. وفي وثبة
نوعية واكبت التحولات الاقتصادية، سلط البحث الضوء على النظام القانوني المستحدث لرد
الاعتبار الجزائي للشخص المعنوي )الشركات والمؤسسات( كآلية للأمن القانوني والإحياء الاقتصادي،
معززاً ذلك بالاجتهادات القضائية المستقرة للمحكمة العليا الجزائرية، لتقديم رؤية أكاديمية متكاملة
تبرز دور هذا النظام في صون حقوق الإنسان وضمان ديمومة النسيج الاجتماعي والاقتصادي.
This research examines and analyzes the system of penal rehabilitation within
Algerian legislation, establishing it as a fundamental pillar of contemporary penal
policy aimed at balancing society's right to deterrence with the convicted
individual's right to reintegrate into the social fabric as a productive and upright
citizen. The study traces the conceptual framework of rehabilitation by clarifying
its essence and its historical and philosophical roots, which are founded on the
"right to criminal oblivion" and the eradication of the stigma of crime and its
negative repercussions, while distinguishing it from similar legal concepts such as
amnesty, pardon, and the statute of limitations on sentences. Furthermore, the
research dissects the procedural pathway, strict conditions, and controls outlined
in the Algerian Code of Criminal Procedure (including subsequent amendments,
Ordinance 05-04, Law 18-06, up to the latest provisions of Law No. 25-14),
illustrating the mechanisms of legal and judicial rehabilitation and their resulting
effects on restoring rights and clearing criminal records. In a qualitative leap
aligned with modern economic shifts, the paper highlights the newly introduced
legal framework for the penal rehabilitation of corporate entities (companies and
institutions) as a tool for legal security and economic revival, supported by the
judicial precedents of the Algerian Supreme Court, thereby offering a
comprehensive academic insight into the role of this system in protecting human
rights and ensuring the sustainability of the socio-economic structure.
