.جرائم الصفقات العمومية وسبل مكافحتها في ظل قانون 23-12

Abstract

تتناول الدراسة بالبحث والتحليل موضوع جرائم الصفقات العمومية وسبل مكافحتها في ظل القانون 23ـ12 المحدد للقواعد العامة للصفقات العمومية بهدف الوقوف على اهم المستجدات التي حملها هذا القانون في سبيل تعزيز وتفعيل اليات مكافحة جرائم الصفقات العمومية، وقد تواصلت الدراسة الى ان الجزائر رصدت في سبيل محاصرة الظاهرة العديد من الاليات الوقائية والردعية ودعمتها باستحداث بوابة الكترونية ومجلس وطني للصفقات العمومية، وهي كلها اليات هامة بأدوار كبيرة، وان كان الوضع يشهد تحديات متعاظمة تؤثر على فعالية تلك الاليات وتحد من دورها في محاضر تلك الجرائم المتعلقة بالصفقات العمومية. Thisstudy examines and analyzes the issue of public procurement crimes and ways to combat them under Law 23-12, which defines the general rules for public procurement. The aim is to identify the most important developments introduced by this law to strengthen and activate mechanisms for combating public procurement crimes. The study continues, noting that Algeria has identified several preventive and deterrent mechanisms to contain the phenomenon and has supported them by creating an electronic portal and a national council for public procurement. These are all important mechanisms with significant roles, although the situation is witnessing growing challenges that affect the effectiveness of these mechanisms and limit their role in the records of these crimes related to public procurement.
