Abstract

يلعب السر المهني دورًا حيويًا في تنظيم العلاقة بين الموظف العمومي ووظيفته، حيث يُعتبر من الواجبات الأساسية التي تحكم سلوك الموظف وتضمن سلامة أداء الإدارة العمومية في التشريع الجزائري. يمثل الالتزام بالمحافظة على السر المهني عنصرًا جوهريًا للحفاظ على الثقة العامة وضمان سير المرافق العمومية بشكل منتظم وفعال. ومع ذلك لا يعد هذا الالتزام مطلقًا، إذ يخضع لضوابط واستثناءات قانونية تهدف إلى تحقيق توازن دقيق بين حماية المصلحة العامة وصون الحقوق الفردية. ويترتب على خرق هذا الالتزام مسؤوليات تأديبية، مدنية، وجنائية، مع التركيز على الضمانات التي أقرها المشرع الجزائري لحماية الموظف أثناء مساءلته.

It is considered one of the fundamental duties governing employee behavior and ensuring the proper functioning of public administration in Algerian law. The obligation to maintain professional secrecy is essential for maintaining public confidence and ensuring the smooth and efficient operation of public services. However, this obligation is not absolute, as it is subject to legal controls and exceptions aimed at achieving a delicate balance between protecting the public interest and safeguarding individual rights. Breach of this obligation entails disciplinary, civil, and criminal responsibilities, with a focus on the guarantees established by Algerian law to protect employees during accountability.
