مسؤولية الإدارة عنأعمال الضبط في الجزائر

Abstract

بإمكاننا القول أنّ من واجب الإدارة خلال مباشرتها لصلاحياتها في مجال الضبط الإداري أن تجد نوعا من المواءمة بين متطلبات الحفاظ على النظام العام، وبين ممارسات الأفراد التي كفّلها القانون إاتّ أنّ ذلك ات يعفى الإدارة من مسؤوليتها وكذا تعويض الأفراد عن الأضرار التي أصابتها من خلال مباشرتها لوظائفها، ومن هذا القبيل يأتي دور المشرّع والقضاء الجزائري في الإقرار بتأصيل مسؤوليّة الإدارة عن أعمالها الماديّة المشروعة وغير المشروعة في حفظ النظام العام على أساس نظريّة الخطأ وكذا بدون خطأ،كما تخضع أعمال الضبط الإداري لرقابة قضائيّة.

I can say that it is the duty of the administration, during the exercise of its powers in the field of administrative control, to find some kind of alignment between the requirements of maintaining public order and the practices of individuals guarantteed by law, but this does not exemt the administration from its responibility, as well as compensating individuals for the damage suffered by them through.
