Abstract

من خلال الدراسة التي أُجريت في إطار البحث في النظام القانوني لبطاقة الدفع الإلكترونية كتقنية جديدة للإنجاز فرضتها البيئة التكنولوجية التي اجتاحت العالم المعاصر، تتجه معظم الدول نحو هذه التقنية الجديدة واستخدامها كبديل للنقود، من خلال إجراء العديد من الإصلاحات الاقتصادية وسنّ التشريعات اللازمة لتنظيمها والتوجه نحو... تُشكّل المعاملات الرقمية تحديًا جديدًا للدول لمواكبة التطورات التي يشهدها العالم. كما أن الطبيعة القانونية الخاصة التي تُميّز بطاقة الدفع عن غيرها من وسائل الدفع استدعت إصدار تشريعات ووضع قوانين تُنظّم العلاقات الناشئة عن استخدامها، وتُحدّد عقوبة من يُسيء استخدامها، بما يوفر الثقة والأمان لمستخدميها. Through the study that was conducted within the framework of research into the legal system of the electronic payment card as a new technology for fulfillment imposed by the technological environment that has swept the contemporary world, most countries are turning to this new technology and using it as an alternative to money, by carrying out many economic reforms and enacting legislation to regulate it and moving towards... Digital transactions are a new challenge for countries to keep pace with developments taking place in the world. The special legal nature that distinguishes the payment card from other means of payment also necessitated the issuance of legislation and the establishment of laws regulating the relationships arising from its use and arranging the penalty for those who misuse it to provide confidence and security to its users.
