آليات ترقية الاستثمار في المناطق الساحلية

Abstract

في ظل الأوضاع الراهنة والأزمات العالمية ومع تدني سعر برميل النفط والاثار التي تركتها الازمة على دول العالم بشكل عام والجزائر بشكل خاص، وبغيت النهوض بالاقتصاد الوطني عملت الدولة الجزائرية على فتح باب الاستثمار وتحسينه والتشجيع عليه من خلال تقديم تسهيلات وضمانات للمستثمرين الوطنين والأجانب في مختلف مجالات الاستثمار ومن الاليات الكفيلة للنهوض بالاقتصاد الوطني العقار السياحي الذي خصه المشرع بمنظومة القانونية باعتباره وسيلة لترقية الاستثمار ودفع عجلة النمو الاقتصادي، حيث ركز المشرع الجزائري على تعزيز استغلال المناطق الساحلية التي تتميز بموارد طبيعية هائلة كمناطق التوسع السياحي والمناطق السياحية التي تمتد على طول الشريط الساحلي الجزائري وفي هذا الاطار أتاح المشرع للمستثمرين لوطنيين والأجانب فرصًا استثمارية عن طريق نظام الترخيص وعقود الامتياز، وفق شروط شفافة، كما منح القانون ضمانات واسعة للمستثمرين، مثل حماية الملكية العقارية، الاستقرار التشريعي، وإمكانية اللجوء إلى التحكيم لحل النزاعات، من جهة أخرى، عززت القوانين الحماية الجنائية ضد الجرائم الاقتصادية التي تهدد الاستثمار، حيث تظهر هذه الدراسة الجهود والمساعي الرامية إلى جعل العقار السياحي أداة فعّالة لتنويع الاقتصاد وتحقيق التنمية المستدامة، خاصة في المناطق الساحلية التي تمتلك إمكانيات تحويلها إلى أقطاب استثمارية كبرى .

In light of the current global situation and crises, along with the decline in oil prices and the effects of the crisis on countries worldwide, particularly Algeria, the Algerian government has aimed to revive the national economy by opening up investment opportunities and improving the investment climate. This has been achieved through the provision of facilities and guarantees to both national and foreign investors across various investment fields. One of the mechanisms capable of boosting the national economy is tourism real estate, which has been addressed by the legislator through a legal framework that considers it a means to promote investment and accelerate economic growth. The Algerian legislator has focused on enhancing the utilization of coastal areas, which possess vast natural resources, as locations for tourism expansion and development along the Algerian coastline. In this context, the legislator has provided both national and foreign investors with investment opportunities through a licensing system and concession contracts under transparent conditions. Furthermore, the law grants extensive guarantees to investors, such as protection of property rights, legislative stability, and the option to resort to arbitration for dispute resolution. Additionally, laws have strengthened criminal protection against economic crimes that threaten investment. This study demonstrates the efforts and initiatives aimed at making tourism real estate an effective tool for diversifying the economy and achieving sustainable development, especially in coastal areas with the potential to transform them into major investment hubs.
