Abstract

التجمعات الاقتصادية ظاهرة فرضتها شروط المنافسة في السوق للتنظيم الاقتصادي. تنشأ عن تجمع عدة مؤسسات أو شركات تمارس نشاطًا اقتصاديًا متطابقًا ومتكاملًا يخدم مصالحها. وهي العملية الأكثر ضمانًا لتحقيق مستويات ملحوظة من التنمية الاقتصادية. لذلك، تلجأ إليها المؤسسات الكبرى في الدول المتقدمة قبل المشاريع الصغيرة. ولتنظيم المنافسة بين الفاعلين الاقتصاديين داخل السوق ومنع تعسفهم، فرض المشرع الجزائري، بموجب قانون المنافسة، على التجمعات الاقتصادية الخاضعة لإشراف مجلس المنافسة، كلما كان من شأن ذلك الإضرار.

Economic groupings are a phenomenon imposed by the competitive conditions in the market for economic regulation. It arises from the gathering of several institutions or companies that practice an identical and integrated economic activity that serves their interests. It is the most guaranteeing process to reach significant levels of economic development. Therefore, major institutions in developed countries resort to it before small projects. In order to regulate competition between economic operators within the market and prevent their arbitrariness, the Algerian legislator, under the competition law, imposed on economic aggregates subject to the supervision of the Competition Council, whenever it would prejudice .
