تسليم المجرمين في القانون الدولي الجنائي (دراسة مقارنة)

Abstract

تتناول هذه الدراسة نظام تسليم المجرمين كأحد أبرز آليات التعاون القضائي الدولي لمكافحة الجريمة العابرة للحدود الوطنية وتحقيق العدالة الجنائية. وتسلط الدراسة الضوء على النظام القانوني الجزائري ومدى مواءمته للمواثيق والاتفاقيات الدولية والإقليمية مثل اتفاقية باليرمو، ونظام روما الأساسي للمحكمة الجنائية الدولية، واتفاقية الرياض للتعاون القضائي) من خلال تحليل أحكام قانون الإجراءات الجزائية الجزائري المعدل بموجب القانون رقم (24-06)، وقانون العقوبات والتعديل الدستوري لسنة 2020 ، تناقش الدراسة الشروط الموضوعية والشكلية للتسليم، مثل مبدأ ازدواجية التجريم، ومبدأ عدم تسليم الرعايا المواطنين)، واستثناء الجرائم السياسية. كما تستعرض الدراسة آليات تفعيل هذا النظام من خلال الاتفاقيات الثنائية (كالاتفاقية الجزائرية الفرنسية لعام (2019) والجهود المشتركة مع المنظمات الدولية كالأمن الدولي (الأنتربول)، مع التركيز على التوفيق بين متطلبات السيادة الوطنية وحماية حقوق الإنسان والالتزامات الدولية.

This study examines the extradition system as one of the most prominent mechanisms of international judicial cooperation in combating transnational crime and achieving criminal justice. It highlights the Algerian legal framework and its compliance with international and regional conventions and treaties, such as the Palermo Convention, the Rome Statute of the International Criminal Court, and the Riyadh Arab Agreement for Judicial Cooperation. The study analyzes the provisions of the Algerian Code of Criminal Procedure, as amended by Law No. 24-06, the Penal Code, and the 2020 constitutional amendment. It discusses the substantive and procedural conditions governing extradition, including the principle of dual criminality, the principle of non-extradition of nationals, and the exception relating to political offenses. Furthermore, the study reviews the mechanisms for implementing the extradition system through bilateral agreements, such as the 2019 Algerian-French Extradition Agreement, and through joint cooperation with international organizations, particularly the International Criminal Police Organization (INTERPOL). It places special emphasis on balancing the requirements of national sovereignty, the protection of human rights, and compliance with international obligations. Résumé : Cette étude examine le système d’extradition en tant que l’un des principaux mécanismes de coopération judiciaire internationale dans la lutte contre la criminalité transnationale et la réalisation de la justice pénale. Elle met en lumière le cadre juridique algérien et son degré de conformité avec les conventions et accords internationaux et régionaux, notamment la Convention de Palerme, le Statut de Rome de la Cour pénale internationale et la Convention de Riyad relative à la coopération judiciaire. L’étude analyse les dispositions du Code de procédure pénale algérien, modifié par la loi n° 24-06, du Code pénal ainsi que de la révision constitutionnelle de 2020. Elle examine les conditions de fond et de forme de l’extradition, telles que le principe de la double incrimination, le principe de la non-extradition des nationaux et l’exception relative aux infractions politiques. En outre, l’étude présente les mécanismes de mise en œuvre de ce système à travers les accords bilatéraux, notamment l’Accord d’extradition algéro-français de 2019, ainsi que la coopération avec les organisations internationales, en particulier l’Organisation internationale de police criminelle (INTERPOL). Elle met enfin l’accent sur la conciliation entre les exigences de la souveraineté nationale, la protection des droits de l’homme et le respect des obligations internationales.
