الضمانات القانونية لممارسة الحق النقابي في التشريع الجزائري

Abstract

يعد الحق النقابي من أبرز الحقوق التي تكفلها التشريعات في الجزائر للعمال و الموظفين ، و يُعتبر أساسًا لتمثيل مصالحهم والدفاع عن حقوقهم في بيئة العمل ، و ينص المشرع الجزائري على حق العمال في تأسيس المنظمات النقابية و الانضمام إليها ، وذلك وفقا للقوانين والتشريعات المعمول بها ، و يعتبر هذا الحق جزءاً لا يتجزأ من الحقوق الأساسية للفرد في ممارسة حقه في التنظيم النقابي دون أي تدخل أو عرقلة قانونية ، كما يوفر التشريع الجزائري إطاراً قانونيا يحمي حقوق المنظمات النقابية و أعضائها ، مما يتيح لها القدرة على القيام بواجباتها في تمثيل المصالح المشتركة للعمال والموظفين و الدفاع عنها بشكل فعّال، و يأتي هذا الحق ضمن سياق قانوني يعزز مبادئ العدالة الاجتماعية والديمقراطية في المجتمع الجزائري ، حيث تعمل المنظمات النقابية كوسيلة لتحقيق التوازن بين مختلف فئات المجتمع العامل وصنع القرارات التي تؤثر في حياتهم المهنية والاجتماعية .

The right to unionize is one of the most prominent rights guaranteed by Algerian legislation for workers and employees. This right is an integral part of the fundamental rights of individuals to exercise their right to union organization without any legal interference or obstruction. This right is embedded in a legal context that promotes the principles of social justice and democracy in Algerian society, where trade unions act as a means to achieve balance among different segments of the working community and to influence decisions that affect their professional and social lives.
