النظام القانوني لبراءة الإختراع في القانون الجزائري

Abstract

تُعدّ براءة الاختراع أداةً رئيسيةً لحماية الاختراعات، ولذلك اعتمد المشرّع مجموعةً من اللوائح والقواعد لتنظيمها. فقد نصّ القانون رقم 03-07 على وجوب أن يكون الاختراع نشاطًا ابتكاريًا، وأن يكون جديدًا وقابلًا للتطبيق الصناعي. كما اعتمد المشرّع الجزائري نظام عدم الفحص المسبق، أي التنازل التلقائي عن براءة الاختراع. وأشار المشرّع إلى الآثار التي تُخلّفها براءة الاختراع على مالكها، كالحق في الاحتكار والتصرف في جميع التصرفات القانونية كالتنازل والترخيص والرهن، مما يُرتب عليه التزاماتٍ عديدة.

كما نصّ المشرّع الجزائري على حماية جنائية ومدنية لبراءة الاختراع، تُخوّله الحق في التعويض، ليتمكن من التظلم من المنافسة غير المشروعة والتقليد. وقد كرّست الاتفاقيات والمعاهدات الدولية، بدءًا من اتفاقية باريس وصولًا إلى اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية، الحماية المدنية لبراءات الاختراع. The patent is a principal tool to protect the inventions, for that the legislator had adopted a set of regulations and rules in to order organize that idea. 03-07. it stated that the invention should hold an innovative activity, the condition of novelty and industrial applicability, the Algerian legislator also adopted the system of no previous examination that is the automatic surrender of the patent. In addition to that the legislator referred to the effects that the patent confers on its owner, such as the right to monopolize and to dispose of all legal actions for instance the assignment, the licensing, and the mortgage, and for that he organizes many obligations that falls on his shoulders. The Algerian legislator also stipulated a criminal and civil protection for his patent, the latter allowing him the right to compensation, so he can make a complaint against unfair competition and imitation. About the civil protection international conventions and treaties have been enshrined, starting from the Paris agreement to the TRIPS once, which are dealing only by ensuring the international protection of patent.
