البعد التداولي للخطاب القانوني الجزائري

Abstract

The research aims to apply what discourse analysis has brought as a new linguistic trend and prominent field of knowledge. It focuses on selected models from the core of Algerian legal discourse, embodied in the opening statements of legal proceedings, responsive pleadings, and court argumentation models issued by official legal bodies under the Algerian legal system. The study adopts a discourse analysis approach, taking into consideration the main principles of this modern methodology. It considers discourse analysis as a linguistic field that focuses on the functional aspect of language, taking into account the sender, the receiver, the context, and the study of how linguistic markers are used and employed to achieve successful communication.

يهدف البحث إلى تطبيق ما قدمه تحليل الخطاب كاتجاه لغوي جديد ومجال معرفي بارز. ويركز على نماذج مختارة من جوهر الخطاب القانوني الجزائري، المجسدة في البيانات الافتتاحية للإجراءات القانونية، والمرافعات المستجيبة، ونماذج الحجاج القضائي الصادرة عن الجهات القانونية الرسمية في ظل النظام القانوني الجزائري. يتبنى البحث منهجية تحليل الخطاب، مع مراعاة المبادئ الأساسية لهذه المنهجية الحديثة. ويعتبر تحليل الخطاب مجالاً لغويًا يركز على الجانب الوظيفي للغة، مع الأخذ في الاعتبار المرسل والمستقبل والسياق، ودراسة كيفية استخدام العلامات اللغوية واستثمارها لتحقيق تواصل ناجح.
