Abstract

تعد المؤسسة العمومية ذات الطابع الصناعي والتجاري أحد أشكال المؤسسات العامة التي تمثل وسيلة فعالة لتحقيق اللامركزية المرفقية في الدولة ذلك كونها تتميز عن غيرها من المؤسسات العمومية وبكون أن المشرع الجزائري خول لها مهمة سير المرافق العامة الصناعية والتجارية من جهة ومن جهة أخرى تتمتع هذه المؤسسات بقدرة على ممارسة نشاطات صناعية وتجارية مشابهة للنشاطات التي تتولاها الشركات الخاصة وبذلك فإنها تخضع لنظام قانوني مزدوج حيث تطبق عليها قواعد القانون الخاص عند ابرامها لعقود مع أشخاصه في حين تخضع لقواعد القانون العام ذلك وفقا للقواعد المطبقة على الادارة في علاقتها مع الدولة، كما يترتب على هذه المؤسسة ممارسة الرقابة الداخلية والخارجية The public industrial and commercial institution in one form of public entities that represent an effective means of achieving public centralization in the state this is because it distinguishes itself from other public institutions Algerian legislation allows these institutions to manage industrial and commercial public facilities on one hand, On the other hand these institutions have the ability to engage in industrial and commercial activities similar to those undertaken by private companies therefore they are subject to a dual legal system applying private law rules when contracting with individuals while being subject to public law rules in their relations with the state as per administrative law principles Additionally these institutions are responsible for internal and external oversight. :
