Abstract

تُجسّد الديمقراطية في نصوصها القانونية من خلال الإصلاحات المعروفة بتعزيز سيادة القانون. وتُعدّ الديمقراطية التشاركية من أهم الآليات التي يتم من خلالها العمل على ضمان مشاركة المواطنين في اتحاد القرارات المحلية، كما تُعدّ مشاركة المواطن في اتحاد القرارات العامة المدخل الأساسي لضمان المشاركة الإيجابية للمواطنين في إدارة الشؤون العامة، وتُشكّل آليةً مهمةً لتقييم السياسات العامة، إذ تهدف إلى تحقيق الشفافية، وتُساهم في تفعيل مبدأ المساءلة، كما تُعدّ وسيلةً مهمةً لضمان الشرعية. إلا أنها في الواقع تُواجه سلسلةً من العراقيل والإشكاليات التي تحد من مشاركة الفاعلين المحليين، كالمجتمع المدني والقطاع الخاص والمواطن، لأن فكرة تجسيدها الفعلي لا تزال مُشوّهة بالغموض بسبب تردد المُشرّع في توسيع نطاق حرية مشاركة المواطن في إدارة شؤونه على نحوٍ أفضل. emocracy in its legal texts through the reforms known to strengthen the rule of law. participatory democracy is considered among the most important mechanisms through which work is done to ensure the participation of citizens in the union of local decisions, just as the citizen’s participation in the union of public decisions, it is considered the basic gateway to ensuring the positive involvement of citizens in the management of public affairs, and it constitutes an important mechanism for evaluating public policies, as it aims to achieve transparency, it contributes to activating the principal of accountability, and is also an important means of ensuring legitimacy. But reality, it encounters a campaign of obstacles and problems that limit the participation of local actors, such as society the civil society, the private sector, and the citizen, because the idea of its actual embodiment is still marred by ambiguity due to the legislator remaining hesitant to expand the granted freedomof citizen participation in the better management of its affairs.
