مساهمة البرلمان في التعديل الدستوري في الجزائر

Abstract

تتناول هذه المذكرة بالدراسة والتحليل دور البرلمان في عملية التعديل الدستوري، باعتباره أحد الفاعلين الأساسيين في تطوير النظام الدستوري وضمان استمرارية ملاءمته للتحولات السياسية والاجتماعية؛ حيث تم تسليط الضوء على المبادرة البرلمانية فى اقترح التعديل الدستوري، وآليات مباشرتها، والقيود الدستورية التي تحدّ من حرية البرلمان في هذا المجال، كاحترام ثوابت الدولة ومبادئها الأساسية، وكذا تم التطرق لدور البرلمان في اقرار مشروع التعديل الدستوري المقدم من طرف رئيس الجمهورية من حيث الإجراءات والشروط التي يتعين توافرها لاعتماد التعديلات. وخلصت المذكرة إلى أن البرلمان، رغم تمتعه بصلاحيات مهمة في التعديل الدستوري، يظل مقيدًا بجملة من الضوابط تكرّس مبدأ المشروعية الدستورية، وتحمي استقرار النظام السياسي من المحاولات التعديلية المتسرعة. . This memorandum studies and analyzes the role of Parliament in the constitutional amendment process, as one of the key actors in developing the constitutional system and ensuring its continued relevance to political and social transformations. It highlights the parliamentary initiative in proposing constitutional amendments, the mechanisms for carrying them out, and the constitutional constraints that limit Parliament's freedom in this area, such as the obligation to respect the state’s constants and fundamental principles. It also addresses Parliament’s role in approving constitutional amendment proposals submitted by the President of the Republic, in terms of the procedures and conditions required for the adoption of amendments. The memorandum concludes that, despite Parliament's significant powers in constitutional amendment, it remains bound by a set of rules that uphold the principle of constitutional legitimacy and protect the stability of the political system from hasty amendment attempts.
