Abstract

تُنظّم الدولة الجزائرية وضعية الأجانب داخلها، فنجد أنها وضعت إجراءات مُختلفة للأجانب عند دخولهم الجزائر، كالتزامهم بجواز سفر وتأشيرة، بالإضافة إلى شروط إقامتهم، إذ يُلزم الأجنبي المقيم بحمل بطاقة إقامة، كما أن خروجه من الجزائر، مهما كان نوع خروجه، يكون اختياريًا من قِبل الأجنبي، أو إجباريًا حيث تُجبره الدولة على المغادرة. بمجرد دخول الأجنبي وإقامته، فإنه يتمتع بمجموعة من الحقوق العامة والخاصة التي تدخل ضمن الحد الأدنى لحقوق معاملة الأجانب، إلا أن تمتعه بهذه الحقوق يجعله ملزماً بالتزامات مالية وأخرى غير مالية فضلاً عن التبعية المدنية، التي ألزمته بها الدولة، وذلك للحفاظ على أمنها الداخلي واستقرارها، فمن غير المعقول أن يتمتع الأجانب بجميع هذه الحقوق ولا يكون عليهم أي واجبات في حقهم، لأن هذا يجعلهم في وضع أفضل من المواطنين، وهذا ما تسعى الدولة إلى تجنبه.

L’État algérien réglemente le statut des étrangers sur son territoire. Il a ainsi établi diverses procédures pour les étrangers entrant en Algérie, telles que l’obligation de détenir un passeport et un visa, ainsi que les conditions de séjour. L’étranger résident est tenu de détenir une carte de résident. La sortie d’Algérie, quel que soit le mode de sortie, est facultative pour l’étranger, ou obligatoire, car l’État l’y contraint. Dès qu'un étranger entre et réside sur le territoire, il peut bénéficier d'un ensemble de droits publics et privés qui relèvent des droits minimaux de traitement des étrangers. Cependant, la jouissance de ces droits les soumet à des obligations financières et non financières, ainsi qu'à une dépendance civile, auxquelles l'État les a contraints, afin de maintenir sa sécurité et sa stabilité intérieures. Il est donc déraisonnable que les étrangers jouissent de tous ces droits sans avoir à assumer aucun devoir, car cela les place dans une situation plus avantageuse que les citoyens, ce que l'État cherche à éviter.

The Algerian state regulates the status of foreigners within it, so we find that it has set various procedures for foreigners when they enter Algeria, such as the obligation to hold a passport and a visa, as well as the conditions of their residence, the resident foreigner is obliged to carry a resident card, and their exit from Algeria also, whatever the type of their exit, is optional on the part of the foreigner, or obligatory as the state forces the foreigner to leave. As soon as the foreigner enters and resides, he is able to enjoy a set of public and private rights that fall within the minimum rights of treatment of foreigners, except that their enjoyment of these rights makes them obligated to financial and others nonfinancial obligations as well as civil dependence, which the state obliged them to, and this is to maintain its internal security and stability, it is unreasonable for foreigners to enjoy all these rights and not have any duties in their right, because this puts them in a better position than the citizens, and this is what the stateseeks to avoid.
