Abstract

الإضراب من الحقوق والحريات الأساسية المنصوص عليها في الدستور، وهو وسيلة مشروعة يلجأ إليها العمال والمستخدمون لتحقيق مصالحهم المهنية. ووفقًا للقانون رقم 23-08، فهو توقف جماعي ومتفق عليه عن العمل، يهدف إلى تلبية مطالب اجتماعية ومهنية بحتة، ويتطلب تطبيق إجراءات محددة لمنع النزاعات الجماعية، بما في ذلك منع الاستبدال أو التبديل خلال فترة الإضراب لضمان حقوق العمال، وعدم استخدام الإضراب كوسيلة ضغط بطرق غير قانونية.

مع ذلك، يجب أن تُجرى الإضرابات في ظل شروط إجرائية معينة، منها استنفاد إجراءات التسوية الودية، وموافقة العمال، وإخطار صاحب العمل، والالتزام بحماية أماكن العمل. هناك قيود جزئية على الإضرابات في بعض المرافق العامة، كالتزام الحفاظ على حد أدنى من الخدمة، واستخدام عمال معينين في مواقع حساسة لضمان استمرارية الخدمة. يُحظر الإضراب منعًا باتًا في بعض المرافق الاستراتيجية والمواقع الحساسة لأسباب أمنية وللحفاظ على النظام العام. وتهدف هذه الشروط والقيود إلى إيجاد توازن بين حق العمال في الإضراب وضرورة استمرار المرافق العامة في تقديم الخدمات الحيوية دون انقطاع. Strike is one of the fundamental rights and freedoms enshrined in the Constitution, and it is a legitimate means used by workers and employees to achieve their professional interests. According to Law No. 23-08, it is a collective and agreed upon work stoppage aimed at meeting purely social and professional demands, requiring the implementation of specific procedures to prevent collective conflicts, including preventing replacement or substitution during the strike period to ensure workers' rights and not to use the strike as a means of pressure in illegal ways. However, strikes must be conducted under certain procedural conditions, including the exhaustion of amicable settlement procedures, workers' consent, notification of the employer, and the obligation to protect workplaces. There are partial restrictions on strikes in some public utilities, such as the obligation to maintain a minimum level of service and the use of certain workers in sensitive positions to ensure continuity of service. Strikes are strictly prohibited in some strategic facilities and sensitive positions for security reasons and to maintain public order. These conditions and restrictions aim to strike a balance between workers' right to strike and the need for public utilities to continue to provide vital services on an uninterrupted basis.
