الحقوق الاقتصادية والاجتماعية للطفل

Abstract

تناولت هذه الدراسة موضوع الحماية القانونية للحقوق الاقتصادية والاجتماعية للطفل، من خلال بيان أهم الحقوق المقررة له، وكذا الآليات المعتمدة لحمايتها على المستويات العالمية والإقليمية والوطنية. وتوصلت الدراسة إلى أن المجتمع الدولي والتشريع الجزائري قد أوليا اهتمامًا بالغًا بالحقوق الاقتصادية والاجتماعية للطفل، لاسيما الحق في التعليم، والصحة، والحماية الاجتماعية، والحق في مستوى معيشي لائق، وذلك من خلال إقرار مجموعة من النصوص والآليات القانونية والمؤسساتية الكفيلة بضمان حمايتها وتعزيزها. غير أن فعالية هذه الحماية تبقى رهينة بمدى حسن تطبيق هذه الآليات وتفعيلها بما يضمن المصلحة الفضلى للطفل..

This study addresses the legal protection of the economic and social rights of the child by highlighting the most important rights guaranteed to children and examining the mechanisms established for their protection at the international, regional, and national levels. The study concludes that both the international community and Algerian legislation have attached great importance to the protection of children's economic and social rights, particularly the rights to education, health, social protection, and an adequate standard of living. This protection is ensured through a set of legal and institutional mechanisms aimed at safeguarding the best interests of the child. However, the effectiveness of such protection depends largely on the proper implementation and activation of these mechanisms.

Cette étude porte sur la protection juridique des droits économiques et sociaux de l’enfant, en mettant en lumière les principaux droits garantis aux enfants et en examinant les mécanismes mis en place pour leur protection aux niveaux international, régional et national. L’étude conclut que la communauté internationale ainsi que la législation algérienne accordent une grande importance à la protection des droits économiques et sociaux de l’enfant, notamment le droit à l’éducation, à la santé, à la protection sociale et à un niveau de vie adéquat. Cette protection est assurée par un ensemble de mécanismes juridiques et institutionnels visant à garantir l’intérêt supérieur de l’enfant.
