الدفتر العقاري كوسيلة اثبات للملكية العقارية في التشريع الجزائري

Abstract

للملكية العقارية دور هام وأساسي في تحقيق التنمية على المستويين الداخلي والخارجي لذلك فإنه مسألة تطهير الملكية العقارية و إثباتها امر لابد منه من أجل حماية المالك والتقليل من المنازعات وهذا لا يتحقق إلا بتطبيق نظام الشهر العيني وتعميمها على كافة التراب الوطني الذي يعتمد اساسا على المسح العقاري الذي يعرف النطاق الطبيعي للعقارات ویحدد ملاكها بدقة ومن ثم أشهر هذه المعلومات في المحافظة العقارية من أجل تأسيس السجل العقاري وبالتالي تسليم الدفتر العقاري الذي يصبح السند الرسمي والوحيد لإثبات الملكية العقارية والذي يعتمد عليه القضاء في حالة نشوءنزاع

The real estate ownership plays an important and fundamental role in achieving development both domestically and internationally. Therefore, the issue of validating and proving real estate ownership is essential in protecting the owner and reducing disputes. This can only be achieved by implementing a system of cadastral survey and extending it to all national territories, which is primarily based on a real estate survey that defines the natural boundaries of properties and accurately identifies their owners. This information is then registered in the real estate department to establish the real estate registry, and the official and only proof of real estate ownership is the delivery of the real estate register, which is relied upon by the judiciary in case of any disputes.
