النزاهة القضائية آ وليات الرقابة على الأعمال القضائية

Abstract

يتناول هذا البحث موضوع النزاهة القضائية باعتبارها ركيزة أساسية لسيادة القانون وضمانة جوهرية لحماية الحقوق والحريات الأساسية. وتهدف الدراسة إلى تحليل المفاهيم والأطر القانونية والمؤسسية المعززة للنزاهة، مع تسليط الضوء على آليات الرقابة والمساءلة المعاصرة ومدى تحقيقها للتوازن بين استقلال القضاء ومبدأ المساءلة. كما تسعى الدراسة إلى بيان مستوى الامتثال للمبادئ الدولية -مثل "مبادئ بنغالور للسلوك القضائي"- حيث ترتبط النزاهة ارتباطاً وثيقاً بالإصلاح الهيكلي الشامل، ولا سيما التحول الرقمي وتحديث نظام التفتيش القضائي، بما ينقله من دوره التقليدي العلاجي إلى دور استباقي وقائي.

This research addresses the topic of judicial integrity as a cornerstone of the rule of law and an essential guarantee for the protection of fundamental rights and freedoms. The study aims to analyze the concepts and legal and institutional frameworks that foster integrity, highlighting contemporary oversight and accountability mechanisms and the extent to which they balance judicial independence with accountability. The study also seeks to demonstrate the level of compliance with international principles, such as the Bangalore Standards of Judicial Conduct, where integrity is inseparable from comprehensive structural reform, particularly digital transformation and the modernization of the judicial inspection system, shifting it from a traditional remedial role to a proactive, preventative one.
