Abstract
تتناول هذه الدراسة موضوع "صلاحيات النيابة العامة في ظل التعديل الجديد لقانون الإجراءات الجزائية الجزائري (القانون 25-14")، حيث تسلط الضوء على المركز القانوني والتنظيمي لجهاز النيابة العامة، وطبيعته المزدوجة التي تجمع بين التبعية الإدارية لوزير العدل والاستقلالية القضائية في ممارسة المهام. كما تبحث الدراسة في الدور المحوري الذي تضطلع به النيابة العامة في الإشراف على أعمال الضبطية القضائية وتوجيهها، مع الحرص على ضمان احترام الحقوق والحريات الأساسية أثناء مرحلة التحريات (مثل التوقيف للنظر وتفتيش المساكن)، من جهة أخرى، يحلل البحث الصلاحيات الواسعة والمستحدثة التي منحها المشرع للنيابة العامة في تحريك الدعوى العمومية ومباشرتها، وتدخلها الفعال في مرحلتي التحقيق والمحاكمة، مع إبراز السلطة التقديرية (سلطة الملاءمة) في التصرف في الشكاوى، وتفعيل الآليات الإجرائية البديلة والحديثة لتسريع وتيرة التقاضي، مثل الوساطة الجزائية، الأمر الجزائي، والمثول الفوري. وتخلص الدراسة إلى أن المشرع الجزائري قد نجح من خلال هذا التعديل في عصرنة المنظومة الإجرائية، محققاً توازناً دقيقاً بين فعالية المتابعة الجنائية ومكافحة الجريمة من جهة، وصون ضمانات المحاكمة العادلة وحقوق الأفراد من جهة أخرى. This study examines the "Powers of the Public Prosecution under the new Algerian Code of Criminal Procedure (Law 25-14)". It highlights the legal and organizational framework of the Public Prosecution, exploring its dual nature that combines administrative subordination to the Minister of Justice with judicial independence in executing its duties. The research investigates the Prosecution's pivotal role in supervising and directing the judicial police, ensuring the strict protection of fundamental human rights and freedoms during preliminary investigations (such as police custody and house searches). Furthermore, it analyzes the expanded and newly introduced powers granted to the Prosecution in initiating and managing public action. This includes its active intervention during the judicial investigation and trial phases, its discretionary power in handling complaints, and the implementation of modern alternative procedural mechanisms to expedite justice, such as penal mediation, penal orders, and immediate appearance. The study concludes that through this amendment, the Algerian legislator has successfully modernized the procedural system, achieving a delicate balance between the effectiveness of criminal prosecution and crime-fighting on one hand, and the safeguarding of fair trial guarantees and individual rights on the other. .
