التسيير المفوض للمرافق العامة في التشريع الجزائري

Abstract

نظراً لأهمية المرافق العامة ودورها الحيوي في تلبية احتياجات المواطنين، اعتمد المشرع الجزائري آليات جديدة لتسيير وإدارة هذه المرافق، سعياً منه لتحديث أداء هذه الهيئات وتحسين جودة الخدمة العمومية. وتُعد تقنية تفويض المرافق العامة إحدى الأساليب الجديدة التي اعتمدها المشرع بموجب المرسوم الرئاسي 15-247، والذي يتضمن تنظيم الصفقات العمومية وتراخيص المرافق العامة. كما أسند هذه الآلية إلى نظام قانوني موحد بموجب المرسوم التنفيذي 18-199 المتعلق بتفويض المرافق العامة. وسعى من خلاله إلى ضبط هذه التقنية وتنظيم الإجراءات التي تحكمها، بالإضافة إلى الرقابة المفروضة عليها بما يحقق الأهداف المرجوة.

Given the importance of public utilities and their vital role in meeting the needs of citizens, the Algerian legislator has adopted new mechanisms for the management and administration of these utilities, in an effort to modernize the performance of these bodies and improve the quality of public service. And the public utility delegation technique Is one of the new methods adopted by the legislator under Presidential Decree 15-247, which includes regulating public procurement and public utility authorizations. He also assigned this mechanism to a unified legal system by Executive Decree 18-199 relating to the delegation of the public utility.
