مشروعية الوسائل الحديثة فـي الإثبات الجنائي

Abstract

تناولت هذه الدراسة أحد أبرز المواضيع الراهنة في القانون الجنائي، ألا وهو مشروعية الوسائل الحديثة في الإثبات الجنائي،باعتبار أن كشف الجريمة وتحديد مرتكبيها يعد من أهم أهداف العدالة الجزائية، وقد أدى التطور العلمي والتكنولوجي إلى توظيف وسائل تقنية وعلمية حديثةو دقيقة في مجال الإثبات بصفة عامة والاثبات الجنائي بصفة خاصة،تقوم على أسس علمية وتسهم في تسريع الوصول إلى الحقيقة. وفي ظل العولمة الرقمية،ظهرت أنماط جديدة من الجرائم تستخدم أدوات تقنية متقدمة، ما دفع بالتشريعات،ومنها التشريع الجزائري،إلى اعتماد وسائل إثبات حديثة تتجاوز في قوتها ومصداقيتها الوسائل التقليدية،نظرا لما تتميز به من دقة وموثوقية عالية، كالبصمة الوراثية، الطب الشرعي، وسائل الاثبات التقنية و الالكترونية.

This study deals with one of the most prominent current topics in criminal law, namely the legitimacy of modern means of criminal evidence, considering that the detection of crime and identification of perpetrators is one of the most important goals of criminal justice. Scientific and technological development has led to the use of modern and accurate technical and scientific means in the field of evidence in general and criminal evidence in particular, based on scientific foundations and contributing to accelerating access to the truth.

In light of digital globalization, new types of crimes have emerged that use advanced technical tools, which prompted legislations, including the Algerian legislation, to adopt modern means of proof that exceed the strength and credibility of traditional means, due to their high accuracy and reliability, such as DNA, forensic medicine, technical and electronic means of proof.
