الحمایة الجنائیة للتوقیع الالكتروني في التشریع الجزائري

Abstract

أدى التطور السريع والمذهل لتكنولوجيا الثورة الرقمية إلى ضرورة البحث عن بديل للتوقيع التقليدي، حتى لا يُشكّل عائقًا أمام المعاملات الإلكترونية عبر الإنترنت، مما سمح بخلق نوع جديد من التوقيع يختلف شكلًا ومضمونًا وتكنولوجيا عن التوقيع التقليدي. ونظرًا لأن الثقة والأمان من المتطلبات الأمنية التي تُثيرها المعاملات الإلكترونية التي تتم في بيئة إلكترونية افتراضية مليئة بالمخاطر المتعلقة أساسًا بانتحال هوية أطراف المعاملات الإلكترونية أو اختراق البيانات الإلكترونية المتداولة، مما استدعى وجود آلية تدعم هذه الثقة، وهذا ما كفله المشرع الجزائري من خلال تقرير الحماية الجنائية للتوقيع الإلكتروني في قانون العقوبات، كما تم التأكيد على هذه الحماية من خلال القانون رقم 04/15 المُحدد للقواعد العامة للتوقيع الإلكتروني والتصديق الإلكتروني. The rapid and astonishing development of the technology of the digital revolution led to the necessity of searching for an alternative to the traditional signature, so that it would not be an obstacle to electronic transactions via the Internet, which allowed the creation of a new type of signature that differs in form, content and technology from the traditional signature. Given that trust and security are among the security requirements raised by electronic transactions . that take place in a virtual electronic environment full of risks related mainly to impersonation of the parties to electronic transactions or penetration of electronic data in circulation, which necessitated the existence of a mechanism that supports this trust, and this is what the Algerian legislator has ensured through a report Criminal protection for electronic signature in the Penal Code, and this protection was also emphasized through Law No. 04/15 specifying the general rules for electronic signature and certification.
