الأليات الدولية لحماية الملكية الصناعية

Abstract

برزت حماية حقوق الملكية الصناعية على أعقاب الثورة الصناعية وما رافقتها من ابتكارات و اختراعات تكنولوجية. ومنه حظيت الملكية الصناعية باهتمام الدول وكدا المجتمع الدولي. فاقرت ضرورة حمايتها سواء على المستوى الوطني او الدولي. وعليه فقد تناولنا الاشكالية التالية / مامدى فعالية الجهود الدولية في إقرار حماية قانونية فعلية لعناصر الملكية الصناعية ؟ وهدا ما اتوجب منا للتعرف أولا على ماهية الملكية الصناعية التي تتمثل في السلطة المباشرة التي يعطيها القانون للشخص على كافة منتجات عقله وتفكيره. أما بالنسبة للحماية الدولية فتناولنا الاتفاقيات التي سعت ونظمت حماية حقوق الملكية الصناعية لا سيما إتفاقية باريس وإتفاقية تريبس. وفي الختام استخلصنا النتائج التالية/ - تعد حقوق الملكية الصناعية من اهم الحقوق الحديثة التي كثر الجدل حولها. - طريقة الحماية تختلف بين الاتفاقيات الدولية والتشريع الوطني الجزائري. - يحمي التشريع الجزائري حقوق الملكية الصناعية وكل ما يتعلق بابداعات العقل البشري. The protection of industrial property rights emerged in the wake of the industrial revolution and the accompanying technological innovations and inventions. Industrial property has gained the attention of countries and the international community. It recognized the need to protect it, whether at the national or international level. Accordingly, we have addressed the following questions How effective are international efforts to establish effective legal protection for the elements of industrial property? This requires us to first familiarize ourselves with what industrial property is, which is the direct authority that the law gives to a person over all the products of his mind and thought. As for international protection, we dealt with the agreements that sought and organized the protection of industrial property rights, especially the Paris Convention and the TRIPS Agreement. In conclusion, we drew the following conclusions - Industrial property rights are one of the most important modern rights that have been the subject of much debate. - The method of protection differs between international conventions and Algerian national legislation. - Algerian legislation protects industrial property rights and everything related to the creations of the human mind.
