الرقابة على الصفقات العمومية في ظل القانون23-12

Abstract

تعتبر الرقابةعلى الصفقات العمومية من الوظائف الهامة التي تهدف الى الحفاظ على المال العام ومحاربة الفساد ,فقد اولاها المشرع إهتماما خاصا في نصوصه نظرا لخطورتها ومالها من صلة بالخزينة العمومية,وذلك من خلال ما جاءت به قوانين الصفقات العمومية المختلفة والتي كان اخرها القانون رقم 23-12الذي يحدد القواعد العامة المتعلقة بالصفقات العمومية والذي خصص الباب الخامس منهالى تنظيم الرقابة على الصفقات العمومية ,وذلك لضمان إحترام القانون والحد من إنتشار الفساد في مجال الصفقات العمومية The control of public transactions is an important function aimed at preserving public finances and combating corruption. In its provisions, the legislature has given special attention to public transactions because of their gravity and their financial implications in relation to public treasury. This is done by means of various public transactions laws, the most recent of which is Act No. 23-12, which sets out the general rules on public transactions, section V of which deals with the regulation of public transactions, in order to ensure respect for the law and to curb the spread of corruption in public transactions.
