النظام القانوني لمجلس الدولة الجزائري

Abstract

يتضمن مضمون هذه الدراسة النظام القانوني لمجلس الدولة في التشريع الجزائري، حيث تتمحور اشكاليته حول الطبيعة القانونية التي يتميز بها النظام القضائي الجزائري ودوره في حماية حقوق وحريات الافراد، انطلاقا من نشأته وتطوره وكذا تشكيلته وتنظيمه، ثم مختلف اختصاصاته القضائية والغير قضائية في النظام القضائي الإداري الجزائري. من اجل تبيان مكانة مجلس الدولة ودوره في تحقيق نظام قضائي عادل يساهم في ارساء قواعد العدالة من جهة وحماية حقوق الافراد في مواجهة الادارة العامة من جهة اخرى. وعليه يعتبر مجلس الدولة الركيزة الأساسية التي يقوم عليها القضاء الإداري في نظام ازدواجية القضاء، فهو ينهض بدور أساسي في حماية مبدأ المشروعية وسيادة القانون من الإعتداءات التي يمكن أن تقع عليه من جانب السلطات العامة في الدولة. The content of this study includes the legal system of the State Council in Algerian legislation, where its problem centers around the legal nature that characterizes the Algerian judicial system and its role in protecting the rights and freedoms of individuals, based on its origin and development as well as its formation and organization, and then its various judicial and non-judicial competencies in the Algerian administrative judicial system. . In order to demonstrate the status of the State Council and its role in achieving a fair judicial system that contributes to establishing the rules of justice on the one hand and protecting the rights of individuals in the face of public administration on the other hand. Accordingly, the Council of State is considered the main pillar on which the administrative judiciary is based in the system of dual judiciary, as it plays a fundamental role in protecting the principle of legality and the rule of law from the attacks that may be inflicted on it by the public authorities in the state .
