النظام القانوني للتصديق الإلكتروني في التشريع الجزائري

Abstract

يلعب التصديق الالكتروني دورا فعالا في ضمان و تفعيل المعاملات التجارية الالكترونية , لذا و لتدعيم مصداقية التجارة الالكترونية و لتوفير الثقة و الأمان بين المتعاملين الالكترونيين ،استحدث المشرع الجزائري آليات إدارية أخضعها لمجموعة من الالتزامات أثناء ممارسة مهامها ،كما رتب عليها تحمل مسؤولية الأضرار التي يرتبها مخالفة هذه الالتزامات ، يطلق عليها بجهات التصديق تشمل كل من سلطات التصديق الالكتروني و مؤدي خدمات التصديق ، فتتولى هذه الجهات مهمة حماية البيانات و المعلومات الخاصة بالمتعاملين عن طريق إصدار شهادات تحدد هوية المتعاملين و صحة التواقيع الصادرة منهم ،مع ضمان سلامة المحرر الالكتروني من أي تحايل أو تلاعب أو تغيير قد يحدث من قبل المتعاملين ، و هذا ما يبرر أهمية التصديق الالكتروني خاصة ضمن العقود التجارية Electronic certification plays an effective role in ensuring and activating electronic commercial transactions. Therefore , in order to strengthen the credibility of electronic commerce and to provide confidence and safety among electronic dealers, the Algerian legislators have developed administrative mechanisms that subject it to a set of obligations during the exercise of its functions. These obligations, called the certification authorities, include both the electronic certification authorities and the certification service provider. These authorities undertake the task of protecting the data and information of the customers by issuing certificates specifying the identity of the customers and the validity of the signatures issued by them, while ensuring the integrity of the electronic document from any fraud or fraud. Manipulation or change may occur by the dealers and this justifies the importance of electronic certification, especially within electronic commercial contracts.
