نظام الإفراج المشروط في التشريع الجزائري

Abstract

تناولنا في هذه الدراسة أحد أهم أنظمة إعادة الإدماج الاجتماعي، وهو نظا م الإفراج المشروط والذي يهدف إلى إصلاح المحكوم عليه وإعادة إدماجه في المجتمع وقد بينا في هذه الدراسة الأهداف التي يسمو لها والشروط الواجب توافرها والإجراءات المتبعة للاستفادة منه. وقد اعتمدنا في هذه الدراسة على المنهج التحليلي وهو المنهج الغالب في دراستنا بغية فهم مضمون النصوص القانونية التي تخدم موضوعنا، كما اعتمدنا على منهج المقارنة خاصة قبل وبعد . تعديل 2006 عاد توصلنا أخيرا إلى أن المشرع الجزايري اخصذ قرارا صائبا في تبنيه لنظا الإفراج المشروط. كما أنه أصاب في طريقة تنظيمه عالشروط التي وضعها ونرى ذلك جليا في تزايد عدد المحكوم عليهم المستفيدين من هذا النظا م كذا تزايد طلبات الإفراج المشروط من طرف المحكو م عليه الذين تحسنت سلوكاتهم داخل المؤسسة العقابية وبذلك يكون هذا النظا م حقق الهدف المنشود منه. In this study, we discussed one of the most important social reintegration systems, which is the conditional release system, which aims to reform the convict and reintegrate him into society. We have explained in this study the goals it achieves, the conditions that must be met, and the procedures followed to benefit from it. In this study, we relied on the analytical approach, which is the dominant approach in our study, in order to understand the content of the legal texts that serve our topic. We also relied on the comparative approach, especially before and after the 2006 amendment. We have finally concluded that the Algerian legislator made a correct decision in adopting the conditional release system. It was also correct in the way it was organized and the conditions it set, and we see this clearly in the increasing number of convicts benefiting from this system, as well as the increase in requests for conditional release from convicts whose behavior has improved within the penal institution, and thus this system has achieved its desired goal.
