السلطة التشريعية في التشريع الجزائري

Abstract

تتناول هذه المذكرة دراسة السلطة التشريعية في التشريع الجزائري،مركزة في فصلها الأول على الإطار القانوني المنظم لهذه السلطة،حيث يتم استعراض تشكيل البرلمان،شروط التصويت،صلاحياته،وآليات عمله وفقا لأحكام الدستور الجزائري،خاصة بعد التعديلات المتتالية، أما الفصل الثاني سلط الضوء على العلاقة بين السلطة التشريعية والسلطات الأخرى ،أي التنفيذية والقضائية ،مبينا حدود التداخل بين الصلاحيات ومظاهر التعاون أو الصراع ،مع التركيز على اختلال التوازن لصالح السلطة التنفيذية مما يؤثر على فعالية العمل البرلماني ويحد من استقلاليته ،وتخلص المذكرة الى ضرورة تعزيز مكانة البرلمان في النظام السياسي لضمان التوازن الحقيقي بين السلطات . This memorandum examines the legislative authority in Algerian legislation, focusing in its first chapter on the legal framework governing this authority. It reviews the composition of Parliament, voting conditions, its powers, and its operating mechanisms in accordance with the provisions of the Algerian Constitution, especially after the successive amendments. The second chapter highlights the relationship between the legislative authority and the other branches of power—namely the executive and the judiciary—demonstrating the necessity of overlapping powers and the aspects of cooperation and conflict, with an emphasis on the imbalance in favor of the executive branch. This imbalance affects the effectiveness of parliamentary work and limits its independence. The memorandum concludes by emphasizing the need to strengthen the role of Parliament within the political system in order to ensure a genuine balance between powers.
