آليات حماية المعلومات والوثائق الإدارية للسلطات العمومية

Abstract

منح المشرع الجزائري للمعلومات والوثائق الإدارية بموجب الأمر رقم 21-09 تحديدا حماية مشددة لم تقتصر عند حد فرض عقوبات تأديبية ومدنية على الموظف العمومي بل تعداها إلى تجريم أي فعل ينتهك سرية هذه المعلومات أو الوثائق الإدارية. لا شك أن آليات الحماية التي كرسها المشرع الجزائري حماية للمعلومات والوثائق الإدارية، تساهم إلى حد كبير في عرقلة الحق في الورول إلى المعلومة في الجزائر رغم إقراره دستوريا، خارة في ظل غياب قانون ينظم هذا الحق ويعمل على تحقيق الموازنة بين حماية المعلومات والوثائق الإدارية التي تفرضها اعتبارات الأمن الوطني وبين حق الأفراد في المعلومة.

Par l'ordonnance n° 21-09, le législateur algérien a accordé une protection stricte aux informations et documents administratifs, ne se limitant pas à infliger des sanctions disciplinaires et civiles aux agents publics, mais incriminant tout acte portant atteinte à la confidentialité de ces informations ou documents administratifs. Il ne fait aucun doute que les mécanismes de protection consacrés par le législateur algérien pour protéger les informations et les documents administratifs contribuent grandement à entraver le droit d'accès à l'information en Algérie malgré son approbation constitutionnelle, surtout en l'absence d'une loi réglementant ce droit et oeuvrant à la réalisation d'un équilibre entre la protection des informations et des documents administratifs qu'elle impose Considérations de sécurité nationale et droit des individus à l'information. Abstract: By Ordinance No. 21-09, the Algerian legislator granted strict protection to administrative information and documents, not limiting itself to inflicting disciplinary and civil sanctions on public officials, but criminalizing any act undermining the confidentiality of these information or administrative documents. There is no doubt that the protection mechanisms enshrined by the Algerian legislator to protect information and administrative documents greatly contribute to hindering the right of access to information in Algeria despite its constitutional approval, especially in the absence of a law regulating this right and working to achieve a balance between the protection of information and administrative documents that it imposes National security considerations and the right of individuals to information.
