Abstract

تتناول هذه المذكرة السلطة التشريعية في التشريع الجزائري، مُركزةً في فصلها الأول على الإطار القانوني المُنظّم لهذه السلطة. وتستعرض تشكيل البرلمان، وشروط تصويته، وصلاحياته، وآليات عمله وفقًا لأحكام الدستور الجزائري، لا سيما بعد التعديلات المتتالية. ويُسلّط الفصل الثاني الضوء على علاقة السلطة التشريعية ببقية السلطتين، التنفيذية والقضائية، مُبيّنةً ضرورة تداخل الصلاحيات وأوجه التعاون والتنازع، مُركّزةً على اختلال التوازن لصالح السلطة التنفيذية، مما يُؤثّر على فعالية العمل البرلماني ويُحدّ من استقلاليته. وتُختتم المذكرة بالتأكيد على ضرورة تعزيز دور البرلمان في النظام السياسي بما يضمن توازنًا حقيقيًا بين السلطات. This memorandum examines the legislative authority in Algerian legislation, focusing in its first chapter on the legal framework governing this authority. It reviews the composition of Parliament, voting conditions, its powers, and its operating mechanisms in accordance with the provisions of the Algerian Constitution, especially after the successive amendments. The second chapter highlights the relationship between the legislative authority and the other branches of power—namely the executive and the judiciary—demonstrating the necessity of overlapping powers and the aspects of cooperation and conflict, with an emphasis on the imbalance in favor of the executive branch. This imbalance affects the effectiveness of parliamentary work and limits its independence. The memorandum concludes by emphasizing the need to strengthen the role of Parliament within the political system in order to ensure a genuine balance between powers.
