Abstract
تناولت هذه الدراسة موضوع التقاضي الإلكتروني في الجزائر باعتباره إحدى أهم آليات عصرنة
قطاع العدالة ومواكبة التحول الرقمي. هدفت الدراسة إلى إبراز الإطار المفاهيمي والتشريعي للتقاضي
الإلكتروني، مع تحليل مختلف الإجراءات العملية المرتبطة برفع الدعوى الإلكترونية، والتبليغ القضائي
الرقمي، وعقد الجلسات المرئية عن بعد، إضافة إلى دور القاضي في إدارة الدعوى إلكترونياً وضمان
اح ترام مبادئ المحاكمة العادلة، كما تطرقت الدراسة إلى الضمانات القانونية والتقنية المتعلقة بحماية
المعطيات الشخصية، وسلامة المحررات الإلكترونية، وحجية التوقيع الرقمي في الإثبات القضائي.
وخلصت الدراسة إلى أن الجزائر قطعت أشواطاً مهمة في رقمنة العدالة من خلال استحداث منصات
إلكترونية وتطوير النصوص القانونية، غير أن نجاح هذا النظام يبقى مرتبطا بتعزيز البنية التحتية
الرقمية، وتكوين الموارد البشرية، وتوسيع الوعي القانوني والتقني لدى مختلف الفاعلين في المنظومة
القضائية.
This study addressed electronic litigation in Algeria as one of the most
important mechanisms for modernizing the justice sector and supporting digital
transformation. The research aimed to highlight the conceptual and legislative
framework of electronic litigation while analyzing the practical procedures related
to electronic filing, digital judicial notification, remote hearings, and the judge’s
role in managing electronic proceedings while ensuring fair trial guarantees. The
study also examined the legal and technical safeguards concerning personal data
protection, the integrity of electronic documents, and the evidentiary value of
electronic signatures in judicial proceedings. The study concluded that Algeria has
made significant progress in the digitalization of justice through the establishment
of electronic platforms and the development of legal texts. However, the success
of this system remains dependent on strengthening digital infrastructure, training
human resources, and enhancing legal and technical awareness among all actors
within the judicial system.
