نظام التعاقد في الوظيفة العمومية

Abstract

أقدمت الوظيفة العمومية في الجزائر على خطوات هامةنتيجة للتحولات والتغيرات السياسية الى جانب التطور في العالم هو االذي ادى إلىتأثير كبير على المنظومة القانونية ودفع بالمشرع الجزائري بالنص من خلال الفصل الرابع من الأمر 03/06 القانون الأساسي للوظيفة العمومية على نظام التقاعد تحت عنوان الأنظمة القانونية الأخرى للعمل وأصدر مرسوم رئاسي 07 308 الذي يحدد كيفيات توظيف الأعوان المتقاعدين وحقوقهم وواجباتهم والعناصر المشكلة براتبهم والقواعد المتعلقة بتسييره وكذالك النظام التأديبي المطابق له فقد اعتبر المشرع هذا النظام كحل سهل وسريع من خلال إخضاع بعد المناصب لنظام التقاعد بموجب عقود عمل محددة المدة وأخرى غير محددة المدة كإستثناء على المبدأ العام القائم على ديمومة واستقرار الوظيفة العمومية بهدف إضفاء المرونة اللازمة على نشاطات الإدارة والمؤسسات العمومية وضمان استمرارية المرافق العامة بإنتظام. The civil service in Algeria has undertaken significant steps as a result of political transformations and changes, along with global development. This has had a substantial impact on the legal system and prompted the Algerian legislator to address it through Chapter Four of Ordinance 06-03, the Basic Law of the Civil Service, concerning the retirement system under the title "Other Legal Systems of Work." Additionally, Presidential Decree 07-308 was issued, which specifies the methods for employing retired personnel, their rights and duties, the elements constituting their salary, the management rules, and the corresponding disciplinary system. The legislator considered this system as an easy and quick solution by subjecting certain positions to the retirement system through fixed-term and indefinite-term employment contracts. This serves as an exception to the general principle of permanence and stability of the civil service, aiming to provide the necessary flexibility for the activities of public administrations and institutions and to ensure the regular continuity of public services.
