جريمة الإهانة والتعدي على الموظف العمومي في التشريع الجزائري

Abstract

يعد الموظف العمومي العصب الحيوي للدولة و المسير لأعمالها ، حيث تناط به مهمة تسيير مرافقها العامة لتمكين المواطن من الحصول على الخدمة العامة على أحسن وجه ، وتحقيقا للمصلحة العامة، ومع تطور نشاط الدولة زاد إتساع عمل الموظف ، فهذا الأخير يعتبر بمثابة حجر الزاوية في أي دولة و المسير لأعمالها، مما أدى إلى إحتكاكه بجمهور المواطنين، فأصبح لا بد من حمايته جنائيا من تعسف الأشخاص الطبيعية والمعنوية لإعتداءاتهم و إهاناتهم القولية و الفعلية ضده،حيث تضمن هذه الحماية إطمئنان الموظف في مجال قيامه بأعماله ليبذل كل مافي طاقته لأداء مهامه على أكمل وجه. فجريمة الإهانة و التعدي على الموظف العمومي من بين أهم الجرائم التي تستوجب الإهتمام بدراستها، بإعتبار أن هذه الجريمة لها جانب مادي يتمثل في الإعتداء على الموظف وجانب معنوي يتمثل في إهانته، ولهذا أقرت معظم التشريعات تجريم كل فعل فيه آثار سلبية تعود بالضرر على نفسية الموظف العمومي وذلك بإعتبار أن التعدي يمس كرامته و يقلل إحترامه.

The public employee is the vital nerve of the state and the conductor of its business, as it is entrusted with the task of managing its public facilities to enable the citizen to obtain public service in the best way, and to achieve the public interest, and with the development of the state's activity, the expansion of the employee's work increased, as the latter is considered as the cornerstone of any state And the conductor of its work, which led to his contact with the masses of citizens, so it became necessary to protect him criminally from the arbitrariness of natural and moral persons for their assaults and verbal and actual insults against him, as this protection guarantees the employee’s reassurance in the field of carrying out his work to do everything in his energy to perform his duties to the fullest. The crime of insulting and assaulting a public employee is among the most important crimes that require attention to be studied, given that this crime has a material aspect represented in assaulting the employee and a moral aspect represented in insulting him, and for this reason most legislations have decided to criminalize every act that has negative effects that harm the psyche of the public employee. Considering that the infringement affects his dignity and reduces his respect.
