Abstract
تتناول هذه الدراسة جريمة الاتجار بالبشر باعتبارها من أخطر الجرائم المنظمة العابرة للحدود، لما تشكله من انتهاك جسيم لكرامة الإنسان وحقوقه الأساسية. وقد هدفت الدراسة إلى بيان الإطار المفاهيمي والقانوني لهذه الجريمة من خلال تحديد مفهومها وأركانها وصورها المختلفة، مع إبراز تطور السياسة التشريعية الجزائرية في مكافحتها، خاصة بعد صدور القانون رقم 23-04 المتعلق بالوقاية من الاتجار بالبشر ومكافحته. كما عالجت الدراسة الآليات الوطنية المعتمدة لمتابعة هذه الجرائم، سواء من خلال النصوص التشريعية التي كرست التجريم والعقاب، أو عبر الآليات القضائية والمؤسساتية المكلفة بحماية الضحايا وملاحقة الجناة. وتوصلت الدراسة إلى أن المشرع الجزائري عزز المنظومة القانونية الخاصة بمكافحة الاتجار بالبشر من خلال تبني مقاربة شاملة تجمع بين الردع الجنائي وحماية الضحايا والتكفل بهم، بما يتوافق مع الالتزامات الدولية للجزائر، غير أن فعالية هذه الجهود تظل رهينة بحسن التطبيق العملي وتكثيف التنسيق بين مختلف الجهات المختصة. This study addresses the crime of human trafficking as one of the most serious forms of transnational organized crime due to its severe violation of human dignity and fundamental human rights. The research aims to clarify the conceptual and legal framework of this crime by examining its definition, constituent elements, and various forms, while highlighting the evolution of Algerian legislation in combating it, particularly following the enactment of Law No. 23–04 on the prevention and suppression of human trafficking. The study also analyzes the national mechanisms adopted to combat this crime through legislative provisions establishing criminalization and punishment, as well as judicial and institutional mechanisms dedicated to victim protection and offender prosecution. The findings indicate that the Algerian legislator has strengthened the legal framework for combating human trafficking by adopting a comprehensive approach that combines criminal repression with victim protection and assistance, in line with Algeria’s international commitments. However, the effectiveness of these measures remains dependent on proper implementation and enhanced coordination among the competent authorities.
