Abstract

هدفت هذه الدراسة إلى تحليل تطور النظام المصرفي الجزائري في ظل الإصلاحات القانونية التي عرفها، ابتداءً من قانون النقد والقرض 90-10 وصولًا إلى قانون النقد والبنوك 23-09. وتناولت الدراسة الإطار المفاهيمي للنظام المصرفي، ومكوناته ووظائفه، ثم استعرضت مسار الإصلاحات التي شهدها النظام المصرفي من خلال مختلف التعديلات التشريعية خلال الفترة (2001–2022)، وصولًا إلى تحليل الأحكام الجديدة التي جاء بها قانون النقد والبنوك لسنة 2023 وأثرها في تنظيم وتسيير القطاع المصرفي في الجزائر. وتوصلت الدراسة إلى أن تطور النظام المصرفي الجزائري ارتبط ارتباطًا وثيقًا بتحديث الإطار القانوني والتنظيمي، حيث أسهمت الإصلاحات المتعاقبة في تعزيز الرقابة المصرفية، وتطوير هياكل الحوكمة، وتحسين كفاءة النظام المصرفي. كما أبرزت أن القانون رقم 23-09 يمثل مرحلة جديدة تهدف إلى تحديث القطاع المصرفي وفتحه أمام فاعلين جدد، إلا أنه لا يزال يواجه تحديات تتعلق بفعالية التطبيق ومواكبة التحولات الرقمية والاقتصادية.

Cette étude vise à analyser l’évolution du système bancaire algérien à la lumière des réformes juridiques qu’il a connues, depuis la loi n° 90-10 relative à la monnaie et au crédit jusqu’à la loi n° 23-09 relative à la monnaie et à la banque. Elle présente le cadre conceptuel du système bancaire, ses composantes et ses fonctions, puis examine le processus de réforme à travers les différentes modifications législatives intervenues durant la période 2001–2022. L’étude analyse ensuite les nouvelles dispositions introduites par la loi de 2023 ainsi que leurs effets sur l’organisation et la gestion du secteur bancaire en Algérie. Les résultats montrent que l’évolution du système bancaire algérien est étroitement liée à la modernisation du cadre juridique et réglementaire. Les réformes successives ont contribué au renforcement de la supervision bancaire, au développement des mécanismes de gouvernance et à l’amélioration de l’efficacité du système bancaire. L’étude souligne également que la loi n° 23-09 constitue une nouvelle étape visant à moderniser le secteur bancaire et à l’ouvrir à de nouveaux acteurs, tout en faisant face à des défis liés à son application effective et à l’adaptation aux transformations numériques et économiques.

This study aimed to analyze the development of the Algerian banking system in light of the legal reforms it has undergone, from the Monetary and Credit Law No. 90-10 to the Monetary and Banking Law No. 23-09. It examines the conceptual framework of the banking system, its components, and functions, and reviews the reform process through the legislative amendments introduced between 2001 and 2022. The study also analyzes the new provisions of the 2023 Monetary and Banking Law and their impact on the organization and management of the banking sector in Algeria. The findings indicate that the development of the Algerian banking system has been closely associated with the modernization of its legal and regulatory framework. Successive reforms have strengthened banking supervision, enhanced governance mechanisms, and improved the efficiency of the banking system. The study further concludes that Law No. 23-09 marks a new stage in modernizing the banking sector and opening it to new market participants. Nevertheless, challenges remain regarding its effective implementation and its ability to keep pace with digital and economic transformations.
