المسؤولية الجزائية للشخص المعنوي في جرائم الأعمال

Abstract

تهدف هذه الدراسة إلى معالجة مشكلة المسؤولية الجزائية للشخص المعنوي الذي كان محل جدال فقهي واسع بين رافض ومؤيد، حيث لم يأخذ المشرع الجزائري بهذا النوع من المسؤولية إلى بموجب التعديل الذي مس قانون العقوبات سنة 2004 فأصبح الشخص المعنوي مسؤولا عن جميع أفعاله الجزائية إذا كان خاضعا للقانون الخاص، وارتكب الفعل من طرف أحد أجهزته أو ممثليه الشرعيين، على أن تكون الأفعال الإجرامية تصب في صالح الشخص المعنوي وأن يوجد نص جزائي يجرم هذا الأخير، ومن جهة أخرى عدل المشرع قانون الإجراءات الجزائية في نفس السنة واستحدث شقا خاص بالإجراءات المتبعة ضد هؤلاء الأشخاص، خاصة فيما يتعلق بتحدي د الاختصاص القضائي والتمثيل أمام أثناء المحاكمة، لينتهي الأمر المطاف بتحميل الأشخاص ى لمعنوية المسؤولة الجزائية بعقوبات تناسب طبيعته المعنوية. This study aims to address the issue of the criminal responsibility of the moral person, which has long been the subject of extensive and controversial debate among jurists. The Algerian legislator did not initially adopt this type of responsibility until the amendment of the Penal Code in 2004, whereby the moral person became responsible for all criminal acts committed in the name of or on behalf of its legal entity. If an act is perpetrated by one of its bodies or representatives, and provided that these acts are criminal offenses serving the interests of the moral person, the legislator expressly established this principle. On the other hand, the legislator also balanced the Algerian Code of Criminal Procedure by establishing a specific chapter for the procedures applicable to these persons, especially regarding determining judicial jurisdiction and representation during the trial. Consequently, the matter concludes with holding moral persons criminally responsible, imposing penalties appropriate to their legal nature .
